Terms of Service
TropiCool Heating, Air Conditioning, and Plumbing

These Terms of Service govern your use of calltropicool.com (the "Site") and the online tools we offer through it, such as appointment scheduling and contact forms. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. WHO WE ARE
The Site is operated by TropiCool Heating, Air Conditioning, and Plumbing ("TropiCool," "we," "us," or "our"), an Ohio company located at 275 Old County Line Rd, Ste P, Westerville, OH 43081. We are licensed by the State of Ohio (License #48965). You can reach us at 614-505-9805.
2. WHAT THE SITE IS FOR
The Site provides information about our residential and commercial heating, air conditioning, plumbing, drain cleaning, indoor air quality, and water heater services, and lets you request appointments, estimates, and other communications from us. Content on the Site is provided for general informational purposes. It is not a substitute for an on-site professional diagnosis, and it does not create a service contract between you and TropiCool.
3. SCHEDULING AND APPOINTMENTS
Submitting a booking or contact form through the Site is a request for an appointment, not a confirmed appointment. Appointments are confirmed when we contact you to confirm a date and time. Availability may vary by season, location, and demand, and we may need to reschedule due to emergencies, weather, or other circumstances outside our control. If you need to cancel or reschedule, please call us as early as possible.
4. PRICING, ESTIMATES, AND SERVICE WORK
Prices, price ranges, coupons, and promotions shown on the Site are estimates or examples and may change without notice. The actual cost of any job depends on the equipment, the condition of your home or building, and the scope of work, and will be confirmed in a written estimate or invoice before work begins. If there is any conflict between pricing on the Site and a written estimate, invoice, or service agreement we provide you, the written document controls.
The performance of service work itself — including workmanship guarantees, manufacturer warranties, and payment terms for completed work — is governed by the written estimate, invoice, membership agreement, or service contract for that job, not by these Terms.
5. PAYMENTS AND FINANCING
Payments for services are processed under the terms stated on your estimate or invoice. Financing, where offered, is provided by independent third-party lenders, is subject to credit approval, and is governed by the lender’s own terms and disclosures. TropiCool is not a lender and does not make credit decisions.
6. MEMBERSHIP PLANS
If you enroll in a TropiCool maintenance membership (such as our WellNest plan), your membership is governed by the membership terms provided at enrollment, including its pricing, renewal, and cancellation provisions. These Terms apply to your use of the Site; the membership terms apply to the plan itself.
7. CALLS, TEXTS, AND EMAIL
When you submit your phone number or email address through the Site, you agree that we may contact you about your service request, appointment, estimate, or account by phone call, text message, or email, including through automated systems. Message and data rates may apply. Consent to marketing texts is not a condition of purchasing any service. You can opt out of text messages at any time by replying STOP, and out of marketing emails by using the unsubscribe link in any message.
8. ACCEPTABLE USE
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Submit false, misleading, or fraudulent information, including fake appointment requests;
- Interfere with the Site’s operation, security, or availability, or attempt to gain unauthorized access to any systems or data;
- Scrape, harvest, or copy Site content or data by automated means without our written permission;
- Impersonate TropiCool, our employees, or any other person.
We may suspend or block access to the Site for conduct that violates this section.
9. OUR CONTENT AND TRADEMARKS
The Site and its content — including text, graphics, logos, photos, videos, and design — are owned by TropiCool or our licensors and are protected by copyright, trademark, and other laws. The TropiCool name and logo are our trademarks. You may view and print Site content for your personal, non-commercial use; any other use requires our prior written permission.
10. REVIEWS AND SUBMISSIONS
If you submit a review, photo, comment, or other content to us or through the Site, you grant TropiCool a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, including in marketing materials. You confirm that anything you submit is yours to share and does not violate anyone else’s rights. We may decline to publish or may remove any submission at our discretion.
11. THIRD-PARTY LINKS AND TOOLS
The Site may link to or embed third-party websites and tools, such as review platforms, financing applications, and scheduling software. We do not control those services and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms and privacy policies.
12. DISCLAIMERS
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ITS CONTENT IS COMPLETE OR CURRENT.
Nothing in this section limits or disclaims any warranty we provide in a written estimate, invoice, or service agreement for work we perform, or any warranty that cannot be disclaimed under applicable law.
13. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, TROPICOOL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This limitation applies to the Site only. Liability relating to service work we perform is addressed in the written agreement for that work and by applicable law. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
14. INDEMNIFICATION
You agree to indemnify and hold TropiCool and its owners, employees, and agents harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.
15. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute arising out of these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Franklin County, Ohio, and you consent to the jurisdiction of those courts. Nothing in this section limits either party’s right to bring a qualifying claim in small claims court.
16. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date above. Your continued use of the Site after changes are posted means you accept the revised Terms.
17. GENERAL
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and TropiCool regarding use of the Site, and they do not create any agency, partnership, or employment relationship. You may not assign these Terms; we may assign them in connection with a sale or reorganization of our business.
